• The submission does not infringe on any third-party intellectual property rights
• You grant BASSWAV a non-exclusive, revocable license to listen to and evaluate your submission
• Submission does not guarantee release, representation, or any contractual obligation
• We will review all submissions and respond within a reasonable timeframe

If we are interested in your music, we will contact you to discuss terms separately. Any release agreement would be a separate contract with its own terms.

5. User Conduct

When using our website, you agree not to:

• Submit false, misleading, or fraudulent information
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or harvest data from our website without permission
• Use our services for any illegal purpose

9. Limitation of Liability

• In no event shall BassWav or its directors, employees, or contractors be personally liable for any claim arising from the use of our website or services.
• This limitation applies regardless of the theory of liability, even if BASSWAV has been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless BassWav, its directors, officers, employees, agents, and contractors from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your violation of these Terms; (b) your use or misuse of our website or services; (c) your violation of any third-party rights; (d) any content or information you submit through our services; (e) any breach of your representations or warranties.

BassWav shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, government actions, cyberattacks, infrastructure failures, internet outages, third-party service outages, power failures, or any other force majeure event.

12. Modifications

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via prominent notice on our website at least 14 days before taking effect. Your continued use of our website after changes constitutes acceptance of the modified terms.

13. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the The Netherlands, without regard to conflict of law principles. Any dispute arising from or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation for 30 days. If negotiation fails, the dispute shall be subject to the exclusive jurisdiction of the competent courts in Limburg, the The Netherlands.

If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and BassWav regarding your use of our website and services. They supersede all prior agreements and understandings.

16. Related Entities

BASSWAV is operated by BassWav, part of the Starspace group. Our related platforms and services (including STARBASE automation agency at starbase.agency) are governed by their own Terms of Service. Use of one platform does not automatically bind you to the terms of another.
